TCG World allows you to interact, collect, create, purchase, transfer and trade unique digital game NFTs assets. TCG World allows users like you to buy and publish on virtual land in TCG World, creating an interactive experience built for, and published on, TCG World. Everything a player owns is registered or stored in/on the blockchain. Your use of TCG World is at your own risk: TCG World is provided to you on an “as is” and “as available” basis. We strive to provide an error-free Website and Services, but make no guarantees in this regard, nor can you derive any rights from statements made on our Website. You may not use TCG WORLD, the Website if you are under 18 years of age (or of if you are aged under the legal limit of the jurisdiction you are residing) or if you are legally incompetent (under guardianship).

This Agreement shall apply and be binding on the End User upon its acceptance. It forms an integral part of the Agreement between you and TCG, and governs our rights and obligations. No specific terms and conditions and no other terms and conditions of the End User or any of its subsidiaries or any third party shall prevail over this Agreement. By using TCG World, you represent and warrant that: (1) all registration and supplied information that you submit will be true, accurate, current and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as required; (3) you have the legal capacity and you agree to abide by these Terms and this Agreement; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Website and our Services by automated and non - human means, whether by bot, script or otherwise. Your actions on the Website(in any form) shall not be pornographic, harassing, threatening, defamatory, hateful, harmful, libelous, racist, xenophobic, infringing on copyrights or trademarks or other intellectual property rights, impersonating, unlawful conduct, as shall be determined by TCG in its sole discretion.

TCG World gives you a personal, worldwide, non-exclusive, non-commercial, non-transferable, non-sublicensable and subject to the boundaries use of the Website and Services. The terms of this Agreement, including, without limitation, will apply to TCG World and its use, including upgrades, unless an upgrade is accompanied by a new version of this Agreement or a separate Agreement. These Terms apply, without limitation or qualification, to any use of the services offered by TCG on the website to anyone. When you choose to create an account, you fully and unconditionally accept these Terms. Each user may create an account on the Website by: • providing his/her user name and e-mail address; • choosing a (strong) password • providing and verifying his/her mobile phone number • accepting the Terms and the Privacy Policy. • By registering, you guarantee that all information and personal data you provide to TCG World are correct. Furthermore, you declare that you are over 18 years of age. You may not transfer your registration or any rights you may have in your account to any other person or entity. You are required to set a user name for your account and user name. We reserve the right, without prior notice, explanation or liability: • refuse or restrict a specific user name; • remove usernames from TCG World completely; We reserve the right, at our sole discretion, to refuse to accept your account registration request. To the extent permitted by law, we also reserve the right at any time to cancel your registration and access to your account or to limit, restrict or otherwise modify your existing access rights to your account or any specific feature or benefit you may enjoy in relation to your account, including but not limited to assets, if we believe, in our sole discretion, that you have violated these Terms or other agreements for any reason. In such a case, you agree that TCG World shall not be required to give you prior notice or explanation of any such action. Unless TCG World gives notice to the contrary within 10 calendar days of such prohibition, a prohibition that completely cancels your access to your account shall be deemed to be an immediate termination of this Agreement. In the event of a suspension, you agree to remain fully bound by the terms of this Agreement until its termination or expiry. We may also, when we believe such action is necessary, without notice, block IP addresses of users that we believe, in our sole discretion, have violated these Terms and the Agreement. We can not be held liable for the loss or theft of a password by you, or any resulting account impersonation. It is your responsibility to take all measures to secure access to your account login and password. You are responsible for the actions of any person using your account, even without your prior consent. You agree to report any fraudulent use of your account, login or password to TCG as soon as possible.

You can request removal of your account at any time under the conditions set by the Website. We reserve the right to suspend you temporarily or permanently in case of violation of the Terms and in particular, but not exclusively, in the following cases: • unlawful, fraudulent, criminal or harmful behavior; • non-compliance with the Terms and/or the Agreement; • use of the Website and/or Services for different purposes; • actions interfering with proper functioning of the Website and/or Services; • no server overload: You may not knowingly perform any actions that may cause the computers used to support the Website, Services to become overloaded or crash; • suspicious transactions; In case of suspension, we shall notify you by email at the email address associated with the account, stating (i) the reason for the suspension, (ii) its scope, (iii) its permanent or temporary nature and, in the latter case, (iv) its duration. In case of permanent suspension, you will have a period of thirty (30) days to proceed with withdrawals from your wallet to an external wallet, at the end of which the account may be deleted. We have the right, but not the obligation, to ask you for an explanation of the account activity that is considered suspicious. You have the right to provide us with any useful information about the account activity considered suspicious. In case of dispute of a suspension measure, you are requested to contact the support team before taking any other action and clearly state your objection(s).

You must keep all password and login information associated with your account confidential and not disclose such information to any third party or allow any third party access to your user account without our prior written consent. You are solely responsible for all activities undertaken and/or expenses incurred under the use of your password and login. You must notify us immediately if you know or suspect that your user account has been accessed by a third party or that your login or password information has been or may have been obtained by a third party. You are solely responsible for ensuring that any processes, devices and/or services you use to access or use TCG World or any of the Website and Services (in particular, without limitation, to acquire, hold, manage and sell NFTs) do not expose you to the risk of viruses, malicious computer code or other forms of interference that could damage your and our computer system and/or the data contained therein. To the extent permitted by law, we exclude any liability for any disruption or damage to your equipment, computer system and/or data thereon in connection with your access to or use of TCG World and/or Services.

We grant you a limited, non-exclusive, non-sublicensable and non-transferable licence to use the Services as provided by us to you, solely as set out in these Terms. Except as expressly permitted in these Terms, you may not reproduce, distribute, adapt, modify, translate, create derivative works from, publish or otherwise use any part of the Services or TCG World content for any purpose without the express prior written permission of us or the applicable rights holder. Any commercial exploitation of the Services or TCG World content without the express prior written permission of us or the applicable rights holder is strictly prohibited. The license is for personal and non-commercial use, it does not comprise the right to commercialize TCG World or elements thereof. You may not perform in-game services during your use of TCG World, for any form of compensation outside of TCG World. Notwithstanding the above, you have the right to capture and stream or otherwise distribute on live streaming platforms and/or video sharing platforms, subject to your adherence, at all times, with our terms of – and the additional obligations imposed by – such platforms, video content of your personal gameplay, provided that such video content shall (a) be compliant with the Posting and Image Policy, (b) be accessible to the general public free of charge and (c) shall contain a disclaimer whereas any views and opinions expressed in such video content are exclusively your own and do not represent views or opinions of ours or any other person or entity associated with us. We reserve the right to revoke such right with regard to existing or potential future content, if it deems any such video content, within its sole discretion, to be, or to potentially be, inappropriate or otherwise detrimental to the operation or commercialization of TCG World. In such event, you hereby agree to immediately remove from public access or alter, as instructed by us, upon first request of us, any such content and that you will not pursue us for any actual or potential loss you may incur in connection with such removal or alteration.

Unless otherwise indicated, all content of TCG, TCG World (Website and Services) are our property and all source code, database, functionality, software, website design, audio, video, text, photographs, and graphics on the website and app and trademarks, service marks and logos contained therein are directly or indirectly owned and controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the Bahamas, foreign jurisdiction and international conventions. Except as expressly provided in these Terms, no part of the Website and/or Services may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. TCG (directly / indirectly) is the owner or licensee of all rights including all copyrights, trademarks and other intellectual property rights relating to or included within TCG World, the website of TCG. These rights include without limitation all rights in respect of all graphics, logos, text elements, images and all other elements included in and deriving from the gameplay and virtual world featured in TCG World, including without limitation in-game names, characters, locations and any virtual assets or items and their associated benefits or properties acquired or provided for use within TCG World.

In the event that any information or data (including without limitation in respect of in-game characters, achievements, NFTs, or any virtual items) relating to you or your use of any of TCG World and Services held by TCG World or any third-party on behalf of or in coordination with TCG World is lost, corrupted or otherwise no longer reasonably available or accessible as determined by TCG World in its sole discretion, you agree that to the greatest extent permissible at law TCG World will have no liability to you of any nature relating to any such information or data.

• General Subject to the following specific rules for virtual items issued as NFTs, you have no ownership rights to any virtual items / assets in TCG World. Assets/virtual items can be changed, replaced, altered or deleted by us at any time, regardless of whether they have been purchased or obtained as part of gameplay. Subject to compliance with these Terms, you are authorised, on a non-exclusive basis, to use, reproduce and display NFTs you legitimately own, for personal purposes and solely in good faith only. Notwithstanding any contrary provisions in these Terms, you have the right to freely dispose of the NFTs you own (sale, loan, donation, transfer, etc.). Under no circumstances you may, without our prior written consent, do or attempt to do any of the following with the NFTs, whether or not owned by you: (i) use the NFT and any rights related to the NFT for commercial purposes, advertising or promotion of any third party product or service; (ii) market merchandise, physical or digital, representing the purchased NFTs; (iii) attempt to claim additional intellectual property rights. Furthermore, you understand and agree that additional restrictions on the use of NFT representing third party rights may be subsequently imposed to ensure compliance with the license granted by the owner of the relevant rights. You agree to abide by all such restrictions. • NFTs Policy TCG World’s gameplay allows you to own certain specific virtual assets, as we may design and release, in form of NFTs issued on the Blockchain. The metaverse of TCG is developed in the Unity Game engine. Smart contracts are implemented in the Solitidity language. NFTs may, but do not have to, be designed as digital collectibles and/or items with a function within TCG Worlds gameplay. Such NFTs are subject to the following policy: Purchase of NFTs: In order to purchase NFTs, you must have (i) a valid and active account and (ii) an active digital wallet. We reserve the right to refuse to offer NFTs for your purchase or to limit your NFT purchases. NFTs may only be purchased at such purchase price and any NFTs available for purchase may only be purchased in such manner and in accordance with such further terms and conditions as we may specify in its sole discretion from time to time (see also: article 11 Purchase). Distribution of NFTs: NFTs may be earned in accordance with the smart contracts functionality, as may be determined in the sole discretion by us. We may offer NFTs for sale or otherwise distribute NFTs in a process and on our terms, in our sole discretion. We do not have the obligation to distribute NFTs. This includes the right to provide NFTs free of charge to any individual user or group of users of TCG World or to third parties. Unless otherwise agreed to in writing, users of TCG World, shall have no similar rights in connection with any issuance and/or distribution of NFTs by us. Risks related to the nature of the NFTs: NFTs are subject to certain inherent risks. These risks include, but are not limited to, the following, which you acknowledge and agree to bear only when acquiring, holding, managing, using, selling and/or otherwise disposing of NFTs: a) NFTs may be restricted to only be used TCG World (it’s – however – possible that the NFTs are usable in other worlds / platforms, but this is never guaranteed by TCG World); b) we do not give any guarantee about the price, market, characteristics or whatsoever of NFT’s; c) we do not give any guarantee NFTs can effectively be resold; d) we make no representations or warranties that any NFTs will retain increase their value. You might lose money. Cryptocurrencies and assets are very volatile and may impact the value of NFTs; e) our platform, your ability to purchase, hold, manage, use, sell and/or otherwise dispose of NFTs is subject to risks, costs, fees, deductions or expenses, which you hereby agree to bear fully and solely; f) our platform may not function properly and may be subject to hacking, malicious software, interruptions and failures. These events may cause delays or failures in your ability to purchase, hold, manage, use sell, or otherwise alienate NFTs; g) Laws may apply in certain jurisdictions and new regulations could be enacted that might limit or require changes to the functionality enabled by our platform, which could impact and/or impede on your ability to purchase, hold, manage, use sell, or otherwise alienate NFTs; h) other changes to our platform could impact and/or impede on your ability to purchase, hold, manage, use sell, or otherwise alienate NFTs. • Withdrawal right In the event of suspension or termination of this Agreement, we shall be entitled, without notice, explanation or liability revoke or otherwise request the transfer to us or a third party to be designated by us in our sole discretion, of all or individual NFTs and to re-transfer such NFTs, for such consideration (if any) as we deem appropriate, to ourselves or to third parties. You acknowledge and accept that you may not be able to access, use, benefit from, transfer and/or otherwise dispose of NFTs following a termination of this Agreement. To the greatest extent permitted by law, we shall neither have any liability for any damage resulting from such loss of access, nor any obligation to refund the purchase price paid for the relevant NFTs. Except as otherwise expressly provided, the use of the Website, Services or the purchase of a NFT does not confer any ownership or other rights in the content, code, data or other materials on the Website that may be accessed through the Website, or in the Services or in any third party rights that may be associated with the Services.

Within your land, you can edit your Metadata to include title, description, URL link, sample image, and logo. All Metadata (and URLs, images or logos linked or uploaded) must comply with these Terms and in particular may not contain links to material or content that is pornographic, threatening, harassing, defamatory, hateful, harmful, libellous, racist, xenophobic, or unlawful/illegal. We reserve the right to moderate and/or remove Metadata that does not comply with these Terms, in whatever way we deem appropriate.

You as End User is aware and fully accepts that payment(s) via the Platform/TCG World are fully at own risk. Payments include a compensation for TCG. The amount of the fee is a percentage of the purchase price and is visible with each purchase. The Seller acknowledges that TCG has the right to amend the fees real time. A completed payment, as well as the sending of cryptocurrencies by you to us cannot be undone. In case of a purchase or sale by a consumer, you as a consumer have in most cases the right to invoke the dissolution of the contract without giving any reason, the so-called “right of withdrawal”. Given that the value of cryptocurrencies is subject to (price) fluctuations and we (nor Buyer or Seller) has influence on this, this right of withdrawal is excluded by us. Therefore, in case of a purchase, you as a consumer do not have the right to terminate the agreement within 14 days. We are not involved in the payment process between Buyer and Seller (other than the payment of the fee). Any errors in the payment, such as quantity, (cryptocurrency) receiving address and email address, is Buyers and Sellers responsibility, as well as passing on any changes. You are responsible for the correctness of the data you have entered. Failure to communicate changes, or failure to do so in a timely manner, is entirely at your own expense and risk.

No modifications, tampering or circumvention: You may not modify, decompile, disassemble or otherwise manipulate or circumvent TCG World or any part thereof, in particular, but not limited to, the underlying rules and mechanisms of the open world code, user interface and/or operating principles. No reverse engineering: You may not reverse engineer or otherwise attempt to derive or otherwise discover the source code for the operation of TCG World. Observation of applicable laws You may use TCG WORLD only as and to the extent permitted by applicable laws, in particular, only to the extent you fully comply with any applicable financial market regulations and similar provisions in using TCG World. The information we provide should not be seen as advice. It is your own responsibility to value the information within TCG World. You are solely responsible for the payment of all sales, use, VAT and other taxes, duties and assessments now or hereafter required or imposed by any governmental authority (collectively, “Taxes”) in connection with your use of the TCG World (including, without limitation, any Taxes that may become due as a result of your ownership, transfer or creation of assets / NFTS).

You may not adapt, reproduce, store, distribute, print, display, publish or create copies or derivative works from any part of TCG World, the Website, Services other than in accordance with the License. No use of bots: You may not utilise any automated software or “bots” in relation to your access or use of the Website and/or Services. No unauthorized server access: You may not connect to the Website through any software other than our login. No data gathering and extraction: You may not use any data gathering and extraction tools or software to extract information from the Website or utilize framing techniques to enclose any of the contents of the Website. No unauthorized use of meta tags: Without our written approval, you may not use any meta tags or other hidden text which incorporate our name or any of its intellectual property including trademarks.

You may not access or use the Website and our Services for any purpose other than that for which we make the Website and our Services available. The following activities are (amongst other) prohibited: make unauthorized use of the Website and/or our Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses. trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords; use the Website to advertise or offer to sell goods and Services, other then permitted; circumvent, disable, or otherwise interfere with security-related features of the Website and/or our Services; decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Website and/or our Services; engage in unauthorized framing of or linking to the Website; systematically retrieve data or other content from the Website to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us; engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools; upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Website or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Website and/or our Services; disparage, tarnish, or otherwise harm, in our opinion, us and/or the Website and/or Services; make improper use of our support services or submit false reports of abuse or misconduct; interfere with, disrupt, or create an undue burden on the Website and/or Services; attempt to impersonate another user or person or use the username of another user; sell or otherwise transfer your profile; use any information obtained from the Website in order to harass, abuse, or harm another person; harass, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Website and/or our Services to you. copy or adapt the Website’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code. except as may be the result of standard search engines or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Website and/or our Services, or using or launching any unauthorized script or other software. use the Website and/or our Services in a manner inconsistent with any applicable laws or regulations.

You acknowledge that certain actions with respect to the NFTs, in particular, without limitation, the transfer of NFTs to third parties, may constitute regulated activities and/or otherwise fall within the scope of regulated activities under applicable law in certain jurisdictions. You acknowledge that you may not use TCG World for such activities and that we make no representation with respect to, or otherwise in connection with, the suitability of TCG World and/or any output generated using TCG World, to engage in any regulated activity or with respect to the compliance of such output with laws and regulations applicable to such activities. We do not recommend, nor do we otherwise advise, that you engage in such activities. If you choose to participate in regulated activities, you do so at your own risk and responsibility. In particular, you are solely responsible for your compliance with all applicable laws and regulatory requirements, including all applicable provisions of financial markets law. You hereby expressly agree that in using TCG World and/or any output generated by the use of TCG World, you will, at your own expense and responsibility, ensure compliance with all applicable legal requirements.

This Posting Policy regarding Posts applies to any comments you post or statements you make in any way in connection with TCG World, in particular on the Website (which, for the avoidance of doubt, includes any associated forums, chat rooms and/or other messaging services) or messages you send to other users in any way, whether facilitated or otherwise permitted (“Posts”). Posts may not, without our prior written consent: • contain personal abuse, obscene language, inappropriate subject matter, obscene, harassing, threatening, hateful, or discriminatory or defamatory comments of any kind, as may be determined by us in our sole discretion, or otherwise violate any third party rights (in particular, without limitation, third party intellectual property rights) and/or applicable laws or court orders; • advertise or promote any person or entity or their goods or services; nor • violate any of the statements below. You hereby grant us a perpetual, irrevocable, worldwide, royalty-free license to: • use any and all communications we deem appropriate in connection with TCG World and/or any of the Website and/or Services or the promotion thereof; and • sublicense to third parties, on such terms and conditions as we deem appropriate, to use any messages we deem appropriate in connection with TCG World and/or any of the Website and/or Services or the promotion thereof. You hereby unconditionally represent that, as of the date of any Post: • you own all rights to your Posts or, alternatively, that you have all necessary rights to grant us the rights described above; • you have paid and will pay in full all fees or other payments in connection with the publication or other use of your Posts; and • your messages do not violate the intellectual property rights, privacy rights, publication rights or other legal rights of any third party. We reserve the right, without prior notice, explanation or liability • limit or remove your ability to post any messages; • prohibit the posting of specific messages; • edit specific messages; and/or • Remove messages entirely from TCG World, the Website or elsewhere related to the Services (including as part of TCG Worlds gameplay) where they appear or are stored.

This Image Policy applies to any images you make available in any manner in relation to any of the Website and/or Services (including as part of the TCGs World gameplay) (“Images”). All rights of whatever nature (including without limitation copyright, registered and unregistered trade mark rights, rights of personality, privacy, confidentiality and any other intellectual property rights) in any Images must belong to you or you must have the right to make the images available in relation to TCG World, the Website and/or Services in accordance with this Image Policy. Pornographic, obscene, harassing, threatening, hateful, discriminatory or defamatory Images, as may be determined by us within our sole discretion, or Images otherwise in breach of or infringing on any third party rights and/or any applicable law or court order, are not permitted. You herewith grant us a perpetual, non-revocable, worldwide and royalty-free license to: • make use of any Posts as we deem appropriate in relation to TCG World and/or any of the Website and/or Services or the promotion of the same; and • sub-license third parties, on such terms as we deem appropriate, to make use of any Posts as we deem appropriate in relation to any to TCG World and/or any of the Website and/or Services thereof. We reserve the right without notice, explanation or liability to: • restrict or remove your ability to share Images or otherwise make them available; • disallow the use of any specific Images; • edit any specific Images; and/or • fully remove any Images from TCG World, the Website and/or Services; We may, but has no obligation to, offer and subsequently amend, alter suspend or discontinue support services with regard to TCG World on such terms as we may determine within our sole discretion. At all times, we have the right to alter, modify, redesign, suspend or discontinue, at any time, any aspect or feature of the Website and/or Services (including without NFTs). In particular, without limitation, we have the right, but no obligation, to maintain, modify and/or update TCG World within its sole discretion. We may, but have no obligation to, provide technical support in respect of TCG World. You acknowledge and agree that such maintenance, updates, alterations, modifications, redesigns, suspensions or discontinuations may affect (also including by limiting or terminating) the functionality of TCG World. We do not undertake to keep any of the Website and/or Services updated. To the greatest extent permitted by law we do not accept liability for any loss or damage which may result either directly or indirectly from reliance by you upon the accuracy or currency of information contained in any of the Website and/or Services or in relation to any Posts or Images, including without limitation where such loss or damage is a result of or contributed to by our possible negligence. We reserve the right, but have no obligation, to license updated iterations of TCG World separately and under different terms.

Unless specified otherwise herein, all use of data shall be subject TCG Worlds privacy policy, as amended from time to time (the “Privacy Policy”). The Privacy Policy, as currently in force, is available on the TCG Worlds website.

TCG World does not make any representation or give any warranty. All warranties are expressly excluded to the maximal extent permitted under applicable laws. In particular, while TCG World has endeavoured to take all reasonable measures and apply appropriate care in the preparation of the content of TCG World, the Website and Services, we do neither represent nor warrant that: • TCG World runs uninterrupted and error-free; • the use of TCG World does not infringe upon any third party’s intellectual property rights; • any information contained in TCG World and/or any of the Website or Services is accurate, adequate, complete or error free or that any Posts or Images are compliant with the Posting Policy and Image Policy.

To the maximum extent allowed by law, TCG World liability towards you and the End User (whether contractual or otherwise) with respect to this Agreement and the use of TCG World shall be limited to damages resulting from wilful misconduct by TCG World.

Links to external websites are provided as a convenience and for informational purposes only; they do not constitute an endorsement or an approval or any warranty by TCG World of any of the products, services or opinions of the relevant entity or organization or individual. TCG World is not responsible for the accuracy, legality or content of external sites or for that of subsequent links. TCG World recommends that you read the privacy policies and the terms of use of external websites before you make use thereof or provide personal information on any external websites.

(a) You agree to indemnify and hold TCG World, its directors, officers and employees harmless from and against any claims, causes of action, demands, loss or damage by reason of (i) a breach of any representation, warranty or covenant hereunder, (ii) any exhibition, presentation, distribution or exploitation of your Assets or any rights therein, and (iii) the negligence, fault or default of you, your employees, authorized agents, servants or independent contractors hired by you, or any subcontractor hired by any of the foregoing. (b) You shall comply with all applicable state, city, and federal laws, ordinances, codes, and regulations which affect your creation of any Assets under these Terms and/or your relationship with TCG World. (c) You agree to notify TCG World promptly, in writing, of any legal claim or action of which you have knowledge, which is in any way related to these Terms, your Assets, your Games, or your obligations hereunder. (d) The warranties, representations and indemnifications contained herein shall survive any termination or expiration of these Terms or your relationship with TCG World.

TCG World may terminate this Agreement if, in TCG’s sole discretion, we determine that there has been a breach these Terms, a material breach of any other Agreement between the Parties or a violation of law. If the cause of such termination is reasonably capable of being remedied, we will provide you notice of what actions you must take to reinstate a state acceptable to us within our sole discretion. If you fail to take such actions or the cause cannot be remedied within 10 calendar days, the Agreement will be terminated with immediate effect. Upon termination, all licenses granted herein end immediately. You will cease using TCG World and return to us or uninstall and destroy any Materials you may have in your possession. The effects of an expiry or termination of this Agreement on any NFTs are governed by article 9.

Notifications

You acknowledge and accept that TCG World shall send any notifications to you hereunder by way of simple unencrypted email to your e-mail address. Any such notification shall be deemed received when it is sent by TCG World to your e-mail address. You are responsible for the correctness of the e-mail address you provide.
Notices to TCG World shall be made by registered mail to TCG World’s registered address. If the e-mail address has changed, you will have to notify us.

Amendments

TCG World reserves the right to amend this Agreement from time to time upon placing any such amendments on the Website or by providing you direct notice of any such changes. Your continued use of any of TCG World, the Website, the Website and Services will be deemed to as acceptance by you of any such changes to this Agreement.

Assignment

You may not assign any of your rights or obligations hereunder, whether by operation of the law or otherwise.

No Waiver

The failure of TCG World to exercise or enforce any right under this Agreement shall neither be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.

Severability

If any provision, or portion of a provision, contained in this Agreement is invalid or unenforceable, the remaining provisions, or the remaining portion of such provision, shall remain in full force and effect. Instead of the invalid provision, a rule shall apply that achieves as closely as possible the intention of the parties in drafting the invalid provision.

Applicable Law and Jurisdiction

This Agreement is governed by the laws of the Bahamas. The mandatory consumer protection regulations applicable in the country where you usually reside shall remain applicable, as long as these offer you extensive protection.

To the maximum extent allowed under applicable laws, all disputes under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the ordinary courts of Bahamas.
